Welcome to our application Trackie. These Terms of Use constitute an End-User License Agreement (EULA) between you (the "End-User") and Trackie ("Developer", "We", "Us"). By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree with these terms, please do not use the App.
Important: This agreement is concluded between you and the Developer only, and not with Apple Inc., Google LLC, or any app store operator.
You acknowledge that this EULA is concluded between you and the Developer only, and not with Apple, Google, or any other app store operator (collectively "Store Operators"). The Developer, not the Store Operators, is solely responsible for the Licensed Application and its content. This EULA complies with the usage rules established by the applicable app store terms and conditions.
The Developer grants you a non-transferable license to use the Licensed Application on any compatible devices that you own or control, subject to the Usage Rules set forth in the applicable app store terms and conditions. The Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where available.

The Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application as specified in this EULA or as required under applicable law. You acknowledge that Store Operators have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify the applicable Store Operator, and the Store Operator will refund the purchase price for the Licensed Application to you (if applicable).
To the maximum extent permitted by applicable law, the Store Operators will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.
You acknowledge that the Developer, not the Store Operators, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:
The App is provided "as is" without warranties of any kind beyond those required by law. To the extent permitted by applicable law, the Developer is not responsible for loss of data, service interruptions, or damage caused by misuse of the App.
Trackie offers an optional voice recognition feature that allows you to log meals by speaking. When you use this feature:
By using the voice recognition feature, you acknowledge that speech recognition services are provided by third parties and are subject to their respective terms of service and privacy policies.
The health and nutrition information provided by Trackie, including calorie calculations, macronutrient recommendations, and activity tracking, is for informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.

All content, design, logos, text, images, and code in the Licensed Application are the property of the Developer and are protected by intellectual property laws. You may not copy, modify, distribute, or use any part of the App without permission.
You acknowledge that in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Developer, not the Store Operators, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You acknowledge and agree that the Store Operators and their subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, the Store Operators will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
You are responsible for maintaining the confidentiality of your account and password. You must notify us immediately of any unauthorized use of your account.
We may update, modify, or discontinue features at any time. We may also update these Terms periodically. If we make significant changes, we will notify you through the App or other reasonable means. Continued use of the App after such notification constitutes your acceptance of the updated Terms.
